Terms of Service

Wysava is provided by Cayden Wise, a sole proprietor located in Indiana, United States (“Wysava”, “we”, “us”). Wysava is operated entirely online; we reach you and you reach us by email.

By creating an account or using Wysava you agree to these terms. If you are agreeing on behalf of a company, you confirm you have authority to bind it.

Wysava is marketing operations software. It stores your brand context, plans campaigns, drafts content using AI, routes work through approvals, and records performance you import.

Wysava does not publish anything anywhere. It has no connection to any advertising platform, social network or email tool, and it cannot post, send or spend on your behalf. Everything it produces is a draft for you to review, export and publish yourself.

• You must provide accurate account information and keep your password secure.
• You are responsible for everything done under your account and by anyone you invite to your workspace.
• You must be at least 16 years old to use Wysava.
• Tell us promptly at wisecreations47@gmail.com if you believe your account has been accessed without your permission.

• Paid plans are billed monthly in advance in US dollars, and renew automatically until cancelled.
• Payments are processed by Stripe. We never see or store your full card details.
• Prices are exclusive of any tax that applies where you are; Stripe collects it where required.
• If you change plan mid-cycle, Stripe prorates the difference — an upgrade charges only the balance for the remainder of the period, not a second full month.
• Each plan includes a monthly allowance of AI credits, enforced by our servers. Running out limits AI generation until the allowance resets; it does not remove your data or restrict access to it.

You can cancel at any time from Settings → Billing. Cancellation takes effect at the end of the period you have already paid for, and you keep full access until then. We do not automatically refund the remainder of a period.

If something has gone genuinely wrong — you were charged in error, or the service did not work — write to us and we will deal with it fairly.

If you are a consumer in the EU or UK you have a statutory right to withdraw within 14 days of subscribing. By starting to use the service immediately you ask us to begin supply during that period, and you may be charged for what you have used if you then withdraw. Nothing here removes rights you have by law.

Wysava uses AI to draft copy, briefs, research summaries and suggested learnings. AI output can be wrong, out of date, or unsuitable for your situation, and it is produced from the context you supply.

You are responsible for reviewing anything Wysava drafts before you publish or send it. That includes checking factual claims, prices, guarantees and legal or regulatory requirements that apply to your advertising. We provide drafting tools; we do not provide marketing, legal, financial or regulatory advice, and we are not responsible for material you choose to publish.

You keep ownership of everything you put into Wysava — brand material, documents, campaigns, content and imported performance data — and of the output generated for you.

You grant us the limited licence needed to host, process and display that material in order to operate the service for you, including sending the relevant parts to our AI provider to produce the output you have asked for. That licence ends when you delete the content or your workspace.

You confirm you have the right to upload what you upload. If you upload material containing other people’s personal data — customer reviews, interview notes, survey responses — you are responsible for having a lawful basis to do so, and our Privacy Policy explains how we handle it.

You agree not to use Wysava to:

• produce or distribute content that is unlawful, deceptive, defamatory, or infringes someone else’s rights;
• create advertising that breaches the rules of the platform it is intended for, or the advertising law that applies to you;
• upload material you do not have the right to upload;
• attempt to breach the security of the service, access another customer’s workspace, or interfere with its operation;
• resell or provide the service to third parties except as the plan you are on permits.

We work to keep Wysava available and dependable, but we do not offer a guaranteed uptime level. The service depends on third parties — hosting, database, AI and payment providers — and may be interrupted by maintenance, provider failures or events outside our control.

We may add, change or remove features. If we make a change that materially reduces what a paid plan provides, we will tell you before it takes effect.

You can delete your workspace at any time from Settings, which cancels the subscription and removes your data as described in the Privacy Policy.

We may suspend or terminate an account that breaches these terms, that is being used unlawfully, or where payment has failed and remains unresolved. Where circumstances allow, we will warn you first and give you a chance to put it right.

Nothing in these terms excludes liability that cannot lawfully be excluded — including for death or personal injury caused by negligence, or for fraud.

Subject to that, we are not liable for indirect or consequential loss, lost profits, lost revenue, lost goodwill, or the cost of substitute services. Our total liability arising from the service in any twelve month period is limited to the amount you paid us in that period.

Wysava is provided “as is”. We do not warrant that AI output will be accurate or fit for a particular purpose, which is why clause 6 asks you to review it.

We may update these terms. If a change materially affects your rights we will give you reasonable notice by email or in the app before it takes effect. Continuing to use Wysava after that means you accept the updated terms; if you would rather not, you can cancel.

These terms are governed by the laws of the State of Indiana, United States, and the courts of Indiana have jurisdiction. If you are a consumer, you keep the benefit of any mandatory protections of the law where you live, and may bring proceedings there.
